Children
The policy of the State of Texas is:
1. to assure that children will have frequent and continuing contact with parents who have shown the ability to act in the best interest of the children;
2. provide a safe, stable and nonviolent environment for the children; and
3. encourage parents to share in the rights and duties of raising their children after the parents have separated or dissolved their marriage.
Generally speaking, a Court automatically presumes both parents will be named Joint Managing Conservators of the children absent bad conduct on the part of the parents. Examples of bad conduct are recent family violence or neglect of the children, drug abuse, and untreated alcoholism.
